To Infinity & Beyond – But don’t ignore new rules

Businesses in the recruitment sector need to pay serious attention to new rules governing the pay and conditions rights of agency staff.

That’s the view of upstream Oil and Gas recruitment specialist Infinity Resources International following the October 1st introduction of the European regulations.

The rules give agency staff similar rights to their permanent counterparts on pay and other basic employment rights, once they have completed 12 weeks of service performing comparable work.

“At the very least, agencies should be testing their existing practices against the regulations,” said Infinity’s chief operating officer, Alan Golightly.

“The unique nature of the economy in north-east Scotland means the specific issues raised by the legislation may not commonly arise in this part of the world, particularly those related to the contractor/employee salary issue – but nevertheless they have to be taken seriously. Any business that buries its head in the sand, in the hope that its operations fall out with the scope of the regulations, is taking a chance. Its really a case of due diligence – reviewing processes and policies to ensure they’re in line with the new obligations. Such a review may lead to an exercise in administrative changes, involving tasks such as amendments to contracts, but the end result of regulatory compliance has to be a priority. Ignoring the rules isn’t an option. They won’t go away.”
